Privacy Policy describes how David T.E. Foster (the “Site” or “we”)
collects, uses, and discloses your Personal Information when you visit
or make a purchase from the Site.

This Privacy Policy applies in addition to the terms and conditions of our Site.

We collect information about your Device Information as follows:

  • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
  • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose: shared
    with our shop processor, WooCommerce, our shipping providers, and if
    you elect to sign up for our newsletter, our newsletter service
    provider, MailChimp
  • Personal Information collected: version

    clicked links, visited pages, abandoned carts/checkouts, and other
    activities that describe how you interact with the Site 

We collect information about your Order as follows:

  • Purpose of collection: to
    provide products or services to you to fulfill our contract, to process
    your payment information, arrange for shipping, and provide you with
    invoices and/or order confirmations, communicate with you, screen our
    orders for potential risk or fraud, and when in line with the
    preferences you have shared with us, provide you with information or
    advertising relating to our products or services.

    with our shop processor, WooCommerce, our shipping providers, and if
    you elect to sign up for our newsletter, our newsletter service
    provider, MailChimp
  • Personal Information collected: name,
    billing address, shipping address, payment information (including
    credit card numbers, debit cards, Venmo or PayPal emails, etc.), email
    address, and phone number.

We collect Customer Support Information as follows:

  • Purpose of collection: to
    aid in resolving any customer inquiries or issues in a timely manner,
    communicate updates about previous orders, and when in line with the
    preferences you have shared with us, update you on newly released
    products.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: when in line with the preferences you have shared with us, shared with our newsletter service provider, MailChimp

SECTION 2: SHARING PERSONAL INFORMATION

We
will not sell or share your data with other third parties, except to
help us provide services and fulfill our contracts with you, and in the
following cases :

  • We use WooCommerce to power our online store.
  • We use various third-party merchandise fulfilment providers to get your items.
  • We use MailChimp to power our newsletter.
  • We use a variety of shipping providers to ship your orders, including Stallion Express, Canada Post, USPS and UPS.
  • We
    may share your Personal Information to comply with applicable laws and
    regulations, to respond to a subpoena, search warrant or other lawful
    request for information we receive, or to otherwise protect our rights.
    If this occurs, you will be notified via the email we have on record for
    you.

If
you follow hyperlinks from our Site to another Site, please note that
we are not responsible for and have no control over their privacy
policies and practices.

Our
website may contain links to other websites of interest. However, once
you have used these links to leave our site, you should note that we do
not have any control over that other website. Therefore, we cannot be

provide whilst visiting such sites and such sites are not governed by

We
use your personal Information to provide our services to you, which
includes: offering products for sale, processing payments, shipping and
fulfillment of your order, and keeping you up to date on new products,

Our
processor WooCommerce uses limited automated decision-making to prevent
fraud that does not have a legal or otherwise significant effect on
you.

Services that include elements of automated decision-making include:

  • Temporary
    blacklist of IP addresses associated with repeated failed transactions.
    This blacklist persists for a small number of hours.
  • Temporary
    blacklist of credit cards associated with blacklisted IP addresses.
    This blacklist persists for a small number of days.

STORAGE DURATION

User data will be stored until the purpose the data was collected for has been achieved.

You will be notified if your data is kept for longer than this period.

HOW WE PROTECT YOUR DATA

We
are committed to ensuring that your information is secure. To minimize
unauthorised access or disclosure, we have put in place suitable
physical, electronic, and managerial procedures to safeguard and secure
the information we collect online.

While
we take all reasonable precautions to ensure that user data is secure
and that users are protected, there always remains the risk of harm. The
Internet as a whole can be insecure at times and therefore we are
unable to guarantee the security of user data beyond what is reasonably

Personal Information will be initially processed in Canada  and then
transferred outside of Canada for storage and further processing,
including to Europe and the United States.

CCPA

Personal Information we hold about you (also known as the ‘Right to
Know’), to port it to a new service, and to ask that your Personal
Information be corrected, updated, or erased. If you would like to

Children

We
do not knowingly collect or use personal data from children under 16
years of age. If we learn that we have collected personal data from a
child under 16 years of age, the personal data will be deleted as soon
as possible. If a child under 16 years of age has provided us with
personal data their parent or guardian may contact our privacy officer.

you would like to know if we have collected your personal data, how we
have used your personal data, if we have disclosed your personal data
and to who we disclosed your personal data, if you would like your data
